Terms and Conditions of Sale
Last updated: 18 October 2026
1. Purpose
These terms govern the sale of the creations offered by the Maison MELIKA on melikaparis.com to any person acting for purposes outside their trade, business or profession. Placing an order constitutes full and unreserved acceptance of these terms, in the version in force on the date of the order.
2. The creations
Each piece is crafted to order in the Maison's partner ateliers in Bangkok. No piece is held in stock: making begins only once the order has been placed.
The materials are stated on each creation's page: 925 silver plated with five microns of 18-carat gold (vermeil), or 18-carat gold, depending on the piece.
Stones are described individually. Where a stone is man-made, French law (Decree No. 2002-65 of 14 January 2002) requires it to be described in French as « synthétique » or « de synthèse », and the word "diamond" used on its own always refers to a natural diamond. In English, the Maison describes such stones as lab-grown. Moissanite is a stone distinct from diamond and is named as such.
Each coloured stone is selected individually. Its hue, its inclusions and the distribution of its colours are its own and may differ from the images shown, which are for illustration only. Such differences arise from the nature of the stone and do not constitute a lack of conformity.
3. Prices
Prices are shown in euros, inclusive of all taxes. Delivery is complimentary, with no minimum order, to all destinations offered on the site. For delivery outside the European Union, any customs duties, taxes and import charges levied by the country of destination are payable by the recipient. The Maison reserves the right to change its prices at any time; creations are invoiced at the price in force when the order is recorded.
4. Orders
An order is recorded when you confirm payment, having had the opportunity to review the details of your basket and its total price and to correct any errors. The Maison then sends you an acknowledgement of receipt by email. The contract is formed at that moment.
The Maison reserves the right to refuse or cancel an order on legitimate grounds, in particular in the case of an abnormal request, a previous payment dispute, an obvious pricing error, or the impossibility of sourcing a particular stone. In that event, any sums already paid are refunded to you in full within fourteen days, without any further compensation.
5. Payment
Payment is made online at the time of ordering, using the methods offered on the site. Payment details are sent directly to the payment provider and are never stored by the Maison.
Ownership of the creation passes to you only upon payment of the price in full. Until then, the piece remains the property of the Maison.
6. Making and lead times
The making time is eight weeks, including making and delivery within France. It runs from receipt of payment, or of the deposit for a bespoke piece, and from receipt of the information needed for making the piece, in particular your ring size. For Nairi Rivière rings, the stone is presented to you within fifteen days from the same starting point; the ring is then crafted around it, within the eight-week period. For delivery outside France, shipping time is added.
In the event of delay, the Maison will inform you and give you a new date. In accordance with Article L216-6 of the French Consumer Code, if delivery does not take place within a reasonable additional period after formal notice, you may terminate the contract and receive a refund of all sums paid within fourteen days.
7. Delivery and condition of the piece on dispatch
Delivery arrangements, the destinations served and lead times are set out in our shipping policy, which forms an integral part of these terms. Risk passes to you upon physical delivery of the piece.
Each creation is inspected and photographed before dispatch. These images record its condition when it is handed to the carrier and serve as a reference in the event of a return.
8. Right of withdrawal
You have fourteen days from receipt of your creation to exercise your right of withdrawal without giving any reason, in accordance with Article L221-18 of the French Consumer Code.
In accordance with Article L221-28 3° of the same Code, this right does not apply to pieces made to your specifications or clearly personalised: a creation designed for you, an engraving, a size outside the sizes offered, or a unique stone selected with you and reserved for your order. This exclusion is brought to your attention and expressly accepted by you before payment.
A request made after the statutory period may be considered by the Maison as a goodwill gesture, on a case-by-case basis. Such a gesture creates no right and sets no precedent.
Return arrangements, costs and the consequences of any diminished value are set out in our withdrawal and refund policy.
9. Bespoke creations
A bespoke creation is the subject of a quotation specifying the piece, the materials, the price and the lead time. Acceptance of the quotation constitutes an order. A deposit of 50% is payable on ordering, with the balance due before delivery.
These creations are not covered by the right of withdrawal. If you cancel your order, the Maison will retain from the deposit the costs actually incurred at the date of cancellation: a stone reserved or purchased, atelier work begun, a design completed, transport committed. These costs will be justified to you in writing, with supporting documents, and any balance will be refunded to you within fourteen days.
10. Statutory guarantees
All creations are covered by the statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and by the guarantee against latent defects (Articles 1641 et seq. of the French Civil Code).
Under the statutory guarantee of conformity, you have two years from delivery in which to bring a claim. You may choose between repair and replacement, subject to the cost conditions laid down by law. You are not required to prove the existence of the defect during the twenty-four months following delivery. The statutory guarantee of conformity applies independently of any commercial guarantee.
Under the guarantee against latent defects, you may request cancellation of the sale or a reduction in the price, under the conditions of Articles 1644 and 1648 of the French Civil Code.
The following do not constitute a lack of conformity: normal wear; the patina of the metal; the gradual change or wearing away of gold plating or rhodium plating, which are by nature wearing finishes and can be renewed through our care services; the characteristics specific to each natural stone; damage resulting from an impact, contact with a chemical, sport, swimming, work carried out by a third party, or use inconsistent with the care recommendations provided to you.
11. Aftercare and after-sales service
Beyond the statutory guarantees, the Maison looks after its creations over time: a first polish, complimentary for one year, complimentary engraving when you order, and a schedule of care services available on request (polishing, cleaning, resizing, stone tightening, soldering, re-gilding of vermeil, rhodium plating). Atelier lead times for this work range from three to eight weeks depending on the location.
Any work carried out by a third party on a MELIKA creation brings our aftercare services for the piece concerned to an end. The statutory guarantees nevertheless remain in force under the conditions laid down by law.
12. Force majeure
The Maison shall not be liable for any failure to perform or any delay attributable to an event beyond its control: closure of or damage to an atelier, strike, import or export restriction, customs hold, carrier failure, natural or health disaster, or the proven impossibility of sourcing a particular stone. Time limits are then suspended and you will be informed accordingly. If the impediment continues for more than sixty days, either party may terminate the contract, and the sums paid will be refunded to you without further compensation.
13. Intellectual property
The designs, models, texts, photographs and the MELIKA name remain the exclusive property of the Maison. The sale of a creation does not transfer any right of reproduction or exploitation. Reproduction of a design, even in part, is prohibited.
14. Complaints and mediation
Any complaint must first be addressed to us directly. If no solution has been found within two months, you may refer the matter at no cost to the consumer mediator whose details appear in our legal notice.
Please note that the European online dispute resolution platform closed permanently on 20 July 2025 and can no longer be used.
15. Governing law
These terms are governed by French law. In the event of a dispute, the French courts have jurisdiction under the conditions provided by law. If any clause is held to be void, the remaining clauses shall continue to apply.
